e-Statements
Disclosure
Upon receipt of your consent, we will provide periodic statements
to you on a monthly or quarterly basis, as applicable, to a
working e-mail address that you have provided to us. You
will be required to use a password to view the electronic
statement. It is your sole responsibility to protect your
password from unauthorized persons. You agree that it is
your responsibility to ensure that the electronic statements
cannot be intercepted or viewed by others. You understand
that you have no expectation of privacy if the statements
are transmitted to an e-mail address owned by your employer.
You further agree to release The Old Fort Banking Company
(“the Bank”) from any liability if the information is
intercepted or viewed by unauthorized parties at your
employer or other e-mail address selected by you.
By accepting the terms of this agreement, you hereby authorize The
Old Fort Banking Company to provide periodic account
statements that may include other required disclosures to
you by electronic mail. For your convenience, we will
continue to mail any applicable 1099 interest forms,
overdraft notices, and any other applicable account notices.
Your authorization means that we can provide you access to
periodic statements of your account electronically to a
working e-mail address provided by you. You are responsible
for notifying us of any e-mail address changes. Notification
of e-mail address changes should be received ten (10) days
before the end of your normal statement cycle. You may
notify us by stopping at any banking office and signing a
change of e-mail address form. If your electronic mail is
returned as undeliverable an attempt will be made to contact
you. If contact cannot be made, your account will be
reverted back to a paper copy of your statement being sent
by U.S. Mail.
The Old Fort Banking Company e-Statements are
encrypted
to prevent unauthorized access and cannot be opened without
your password.
You have the right to withdraw your consent to receive electronic
statements at any time. To withdraw your consent to receive
electronic statements, you may notify us by calling the
e-Statements Department at 419-447-6150 or by stopping at
any of our banking offices.
The withdrawal of your consent should be received at
least ten (10) days before the end of your normal statement
cycle.
All electronic statements shall be in full compliance with
applicable laws and regulations. The provisions in this
agreement are part of (and supplemental to) The Old Fort
Banking Company’s Deposit Account Terms and Conditions and
are subject to all the provisions in the Deposit Account
Terms and Conditions. Each account of The Old Fort Banking
Company that you designate to be included within the
e-Statements service and e-Statements program is also
governed by the terms and conditions otherwise applicable to
that kind of account as separately disclosed to you, either
in the Deposit Account Terms and Conditions, applications
and enrollment forms, the applicable personal or business
fee schedules, credit or deposit agreements, our Privacy
Policy or other written disclosures.
As a matter of reference to “Deposit Account Terms and Conditions”,
you agree that the time you have to examine your statement
and report to us will depend on the circumstances, but you
will not, in any circumstances, have a total of more than 30
days from when we first send or make the e-Statement
available to you.
I have read and agree to the terms of the e-Statements Disclosure
and I would like to receive e-Statements delivery. I
understand that for the accounts listed on the e-Statements
application, I will no longer receive a periodic statement
sent by U.S. Mail. If you agree to the terms, please sign
and date the application signifying your acceptance.
I understand that the Bank will send a test e-mail to the
address(es) I have provided.
After receiving a positive response to the test
e-mail, the Bank will begin sending statements via e-mail
effective with my next statement.
I further understand that I will receive my statements, along with
any required disclosures, via e-mail, rather than by U. S.
Mail. I will
ensure the confidentiality of my password and I agree to
indemnify, defend, and hold harmless, the Bank and its
successors, assigns, affiliates, officers, employees,
directors and agents against any loss, claims, damages,
judgments, awards, legal obligations, costs or expense,
including, without limitation, all fees and expenses of
Bank’s counsel based upon, arising out of, or related in any
way to the Bank’s honoring this request.
The individual signing the e-Statements application must be
an authorized signer for each account listed on the
e-Statements Application Form.
